{"id":25,"date":"2024-03-17T21:55:43","date_gmt":"2024-03-17T21:55:43","guid":{"rendered":"https:\/\/birnamwood-fairfax.com\/?page_id=25"},"modified":"2025-04-24T02:52:50","modified_gmt":"2025-04-24T01:52:50","slug":"disclosres","status":"publish","type":"page","link":"https:\/\/birnamwood-fairfax.com\/index.php\/disclosres\/","title":{"rendered":"DISCLOSRES"},"content":{"rendered":"\n<p class=\"has-text-align-center has-large-font-size\"><strong>What is a <span style=\"text-decoration: underline;\">H<\/span>ome<span style=\"text-decoration: underline;\">O<\/span>wners <span style=\"text-decoration: underline;\">A<\/span>ssociation?<\/strong><\/p>\n\n\n\n<p class=\"has-text-align-center has-medium-font-size\">A homeowner association is typically a non-profit corporation controlled by an elected board of directors that has a set of governing documents \u201cCovenants and By-Laws\u201d that are recorded with the county and are legally binding.&nbsp; The \u201crestrictive covenants\u201d are intended to define the standards of the community so as to protect property values.&nbsp; These restrictions vary widely among associations and can control everything from parking to fences, sheds, architectural improvements; even exterior paint, roof material and color, and even basketball goals.<\/p>\n\n\n\n<p class=\"has-text-align-center has-large-font-size\"><strong><span style=\"text-decoration: underline;\">How do Homeowners Benefit?<\/span><\/strong><\/p>\n\n\n\n<p class=\"has-text-align-center has-medium-font-size\">Communities benefit from shared amenities such as pools, tennis courts and clubhouses.&nbsp; The cost of operating and maintaining the community amenities as well as mowing community spaces, electricity for street lights, water for irrigation and pools, paving\/parking, signage and security to list a few of the monetary responsibilities.&nbsp; The cost of maintaining and operating the community amenities are paid by the members in the form of \u201cannual assessments\u201d. These assessments are mandatory and failure to pay typically leads to fines, restriction from amenities, property liens, and can ultimately include foreclosure.<\/p>\n\n\n\n<p class=\"has-text-align-center has-large-font-size\"><span style=\"text-decoration: underline;\"><strong>Board of Directors\u2019 Responsibilities<\/strong><\/span><\/p>\n\n\n\n<p class=\"has-text-align-center has-medium-font-size\">The Board of Directors have a fiduciary responsibility to act in the best interest of the community. This includes attending board meetings, keeping records, making or amending rules, collecting assessments, paying bills, providing financial reports, holding an annual member meeting, and generally operating the association like a business.&nbsp; Often, associations will hire a \u201cmanagement company\u201d to perform the day to day duties.
