- Use of Alcohol:
Use of alcohol is allowed in the Clubhouse, and common areas only by prior approval and under conditions outlined below:- A. If the Clubhouse is used for an Event where alcohol is being served Renter agrees that he will have at his sole cost and expense (2) two off-duty uniformed Constable’s for the entire event. Alcohol shall not be served until the off-duty uniformed officer is on the premises. (Two officers are required to be present by the County when alcohol is to be served.)
- B. The Renter must make arrangements with the Constables office, and the Renter agrees to pay the Constables directly for their services. The fee is $40 per hour with a minimum of 4 hours for each of the 2 required Constables, a minimum of $320 directly to the Constables (the Renter agrees to pay directly to the Constables ((preferably with cash) for their services) and an additional $80 for each hour or partial hour over four hours, email:

- C. Renter acknowledges that the serving and consumption of alcohol on the premises and any and all consequences thereof, are the responsibility of Renter and not the BWFHOA.
- D. Renter may not serve alcoholic beverages to individuals less than 21 years of age or to individuals that are intoxicated.
- E. Renter agrees to indemnify, defend and hold the BWFHOA, its employees, authorized agents, affiliates, officers and directors harmless with respect to any and all claims, injuries, damages, losses and expense resulting from or arising out of the serving and/or consumption of alcohol by any individual at or during the event and Renter hereby releases the indemnified parties from any and all such liability.
- F. Any infractions of the provisions of this Section will subject this Agreement to immediate termination, without recourse by Renter.

- Term:
Any use beyond the maximum five hours will be charged at the rate of $25/hr. - Security Deposit and Administrative Fee:
The $25.00 Administrative fee is paid directly to ACMI and is nonrefundable. - Cancellation:
Written notice is required a minimum of seven (7) days prior to the scheduled Event to cancel the rental and this Agreement. If the Agreement is so timely cancelled, all but $25 of the rental fee shall be refunded with the remainder retained to offset administrative expenses related to this Agreement. If the Agreement is not timely cancelled, the entire rental fee shall be forfeited. - Miscellaneous Items:
- A. Furniture may not be moved. Any BWFHOA owned item missing at the end of the event will be replaced at the cost of Renter. b. All guests must leave promptly at the end of the rental time in the agreement.
- C. All trash and debris must be removed from the premises i.e. Clubhouse, surrounding common areas and parking lot.
- D. No hanging of decorations are permitted inside the Clubhouse on the walls, except 1 banner may be hung between the 2 columns as long as the banner is attached with string, rope, tape or tack ON TOP OF THE COLUMNS so that NO holes or tape residue are visible. Also, there cannot be any decorations etc. placed, posted or hung in the covered patio area.
- E. Lost or stolen articles are not the responsibility of the BWFHOA.
- F. This Agreement may be modified or amended in writing only, signed by the BWFHOA and Renter.
- G. This Agreement along with the “Clubhouse Rules” represent the entire agreement of the parties and there are no representations, written or oral, not specifically set forth herein.
- H. The BWFHOA does not warrant or represent the Clubhouse is fit for any particular purpose and it is Renter’s responsibility to determine if the facilities are suitable for Renter’s intended use.
- I. Renter agrees to advise his guests of the provisions of this Agreement with respect to the warnings and requirements set forth herein.
- J. In the event this Agreement is executed by more than one individual on behalf of Renter, the obligations herein shall be joint and severable.
